الدفوع الشكلية والموضوعية لدعاوى الوقف والوصية والميراث وتطبيقاتها في المحاكم الشرعية

Abstract

ملخص الرسالة: إن موضوع هذه الرسالة يعالج قضية مهمة، وهي الدفوع الشكلية والموضوعية لدعاوى الوقف والوصية والميراث، وتطبيقاتها في المحاكم الشرعية؛ لما لهذا الموضوع من أثر كبير في تسهيل مصالح الناس، ورد المظالم لأصحابها، وليس هذا وحسب، وإنما يساعد في الوصول إلى العدالة في حكم القاضي، وهذه الرسالة تتكون من فصل تمهيدي وثلاثة فصول كالآتي: الفصل التمهيدي: بعنوان"مفهومالدعوى، ومشروعيتها، وتقسيماتها، وشروطها، وأثرها" ويتكون من مبحثين، كما يلي:المبحث الأول: تكلمت فيه عن مفهوم الدعوى لغة، وشرعاً، وقانوناً، ومشروعية الدعوى، والمبحث الثاني: تحدثت فيه عن أطراف الدعوى، والتمييز بين المدعي والمدعى عليه، وشروط صحة الدعوى، وإجراءات الدعوى. الفصل الأول: بعنوان"مفهوم الدفوع، ومشروعيتها، وتقسيماتها، وشروطها، وأثرها" ويتكون من ثلاثة مباحث، كما يلي:تناولت في المبحث الأول بيان مفهوم الدفوعلغة، وشرعاً، وقانوناً، ومشروعية الدفوع، وأما المبحث الثاني فتكلمت فيه عن تقسيمات الدفوع وشروط الدفوع، وفي المبحث الثالث تناولت فيه أحكام الدفع وأثاره، ووقت إبدائه وبيان دفع الدفع. الفصل الثاني:بعنوان "الدفوع الشكلية مفهومها، وصورها في المحاكم، وتطبيقاتها" وهو يتكون من ثلاثة مباحث، كما يلي:المبحث الأولتكلمت فيه عن مفهوم الدفوع الشكلية، وقواعدها، وأثرها والتفريق بينها وبين الدفوع الموضوعية، أما المبحث الثانيفتناولت فيه بيان صور الدفوع الشكلية أمام المحاكم الشرعية، أما المبحث الثالث فتكلمت فيه عن تطبيقات الدفوع الشكلية لدعاوى الوقف والوصية والميراث. الفصل الثالث: بعنوان "الدفوع الموضوعية لدعاوى الوقف، والوصية، والميراث، وتطبيقاتهم في المحاكم الشرعية" وهو يتكون من مبحث تمهيدي، وثلاثة مباحث، كما يلي: المبحث التمهيدي تناولت فيه الدفوع الموضوعية من حيث مفهومها، وخصائصها، ووقت اثارتها، وأما المبحث الأولفتكلمت فيه عن الدفوع الموضوعية لدعاوى الوقف وتطبيقاتها في المحاكم الشرعية، والمبحث الثاني تناولت فيه الدفوع الموضوعية لدعاوى الوصية وتطبيقاتها في المحاكم الشرعية، وفي المبحث الثالث تكلمت فيه عنالدفوع الموضوعية لدعاوى الميراث وتطبيقاتها في المحاكم الشرعية. وأخيراً جاءت الخاتمة التي استخلصت فيها أهم النتائج والتوصيات..
