القواعد والضوابط الفقهية في الأحوال الشخصية عند المالكية

Abstract

ملخص الرسالة: الحمد لله حمد الشاكرين الموحدين، ملء السماوات والأرض، والصلاة والسلام على خير البشر، سيدنا محمد وعلى آله وصحبه أجمعين، وعلى من سار على نهجهم، واقتفى أثرهم إلى يوم الدين، وبعد: قد اهتمّ علماء المسلمين –جزاهم الله كل خير- اهتمامًا كبيرًا في العلوم الشرعية، وفي مسائل الفقه الإسلامي خاصة، ومن ضمن فروع الفقه التي اهتمّ بها العلماء استخراج ومعرفة القواعد والضوابط الفقهية، فبهذا العلم تمّ جمع وحفظ الفروع والجزئيات الفقهية المتناثرة في بطون الكتب، مما جعل هذا العلم سهلًا ميسورًا للباحثين وللقضاة والمفتين. إن موضوع الرسالة يتحدث عن استنباط ومعرفة القواعد والضوابط الفقهية في الأحوال الشخصية عند المالكية، وبيان المقصود بها وتطبيقاتها من الفروع، وقد قسّمتُ رسالتي إلى فصل تمهيدي وأربعة فصول وخاتمة: الفصل التمهيدي: جعلته في مقدمات حول القواعد والضوابط الفقهية من تعريف للقاعدة وللضابط الفقهي، وأهميتهما وفائدتهما، والفرق بين القاعدة الفقهية وبين الضابط الفقهي وبين النظرية الفقهية، وأركانهما وشروطهما، ومصادرهما، ومدى حجيتهما، وتاريخ القواعد والضوابط الفقهية، والمصادر التي عنيت بهما. الفصل الأول: جعلته للقواعد الفقهية في الأحوال الشخصية، واحتوى على سبع قواعد. الفصل الثاني: جعلته للضوابط في مقدمات النكاح، وقد قسمته إلى ثلاثة مباحث، واحتوى على سبعة عشر ضابطًا. الفصل الثالث: جعلته للضوابط المتعلقة بانحلال عقد الزواج، وقد قسمته إلى أربعة مباحث، واحتوى على سبعة ضوابط. الفصل الرابع: جعلته للضوابط المتعلقة بآثار عقد النكاح، وقد قسمته إلى ثلاثة مباحث، واحتوى على خمسة ضوابط. وفي نهاية الرسالة وضعت الخاتمة حيث اشتملت على أهم النتائج التي توصل إليها الباحث، ثم أهم التوصيات. والحمد لله رب العالمين

Abstract Praises be to Allah. Praises and thanks that fill the heavens and the earth and prayers. And peace be upon the best of creatures, His prophet Muhammad, and upon those who follow his path till the Day of Judgment. Muslim scholars – may they be rewarded - have paid great attention to Islamic sciences, and in matters of Islamic jurisprudence in particular, and among the branches of jurisprudence that scholars have been interested in is the extraction and studying of the rules and controls of jurisprudence. In this science, the branches and sections of jurisprudence scattered in the books have been collected and preserved, making this science easy for researchers, judges and Muftis. The subject of the thesis talks about the inference and finding out the rules and controls of jurisprudence in the personal status of the Maliki school. And the researcher divided his thesis into a preliminary chapter and another four chapters: Preliminary chapter: The researcher made this chapter as an introduction to the rules and controls of jurisprudence. The introduction included the definitions of the rule and the control, the importance and benefit of them, the difference between the jurisprudential rule and the jurisprudential theory in addition to their pillars, conditions, sources, the extent of their opposability, and finally the history of the jurisprudential rules and controls and their sources. The researcher has dedicated the first chapter for the jurisprudential rules in the personal status, and it included seven rules. The researcher has dedicated the second chapter for the controls of marriage and its conditions, and it’s divided into three topics and included seventeen control. The researcher has dedicated the third chapter for the controls related to marriage conditions, and it’s divided into four topics and included seven controls. The researcher has dedicated the fourth chapter for the controls related to the effects of marriage contract, and it’s divided into three topics and included five controls. Finally, the researcher has concluded the thesis and covered the most important results and findings, and added his recommendations.
