دور الدبلوماسية الفلسطينية في دعم قضية الأسرى (2024-1994)

Abstract

ملخص الدراسة هدفت هذه الدراسة إلى التعرّف على دور الدبلوماسية الفلسطينية، سواء الرسمية أو الشعبيةاو الرقمية، في دعم قضية الأسرى؛ حيث تمّت مناقشة مراحل تطوّر الدبلوماسية الفلسطينية الرسمية والشعبية، والتعرّف على التحديات التي تواجهها، وتركيز الضوء على الانتهاكات التي يتعرّض لها الأسرى، مع التطرّق إلى حجم الانتهاكات التي حدثت بعد أحداث السابع من أكتوبر 2023. وحشد الدعم الدولي لحقوقهم. بالإضافة إلى ذلك، تمّ تناول الدور الحيوي الذي تقوم به المنظمات غير الحكومية والمجتمع المدني في دعم الأسرى، وكيف ساهمت هذه الجهات في توثيق الانتهاكات التي يتعرّض لها الأسرى الفلسطينيبن،وأيضا التعرف على دورها في فضح ممارسات الاحتلال المتكررة. تستند الدراسة إلى منهج تكاملي يجمع بين الوصفي التحليلي، التاريخي، ومقترب الدور. يستخدم المنهج الوصفي لتحليل جهود الدبلوماسية الفلسطينية بدقة، بينما يتتبع التاريخي تطور هذه الجهود. ويركز مقترب الدور على الأدوار التي تقوم بها الدبلوماسية، والمنظمات، والمجتمع المدني في دعم قضية الأسرى، بهدف تقديم فهم شامل لدور الدبلوماسية الفلسطينية في القضية على المستوى الدولي. توصلت الدراسة إلى مجموعة من النتائج، منها: 1. التناقض بين القانون الدولي وواقع الأسرى: ينص القانون الدولي الإنساني على حقوق للأسرى، إلا أن الأسرى الفلسطينيين في السجون الإسرائيلية يتعرضون لانتهاكات جسيمة تشمل التعذيب والتنكيل، ما يتناقض مع هذه الحقوق 2. نجحت حملات المناصرة والضغط التي قامت بها الدبلوماسية الشعبية والمؤسسات المدنية الفلسطينية في توجيه الاهتمام الدولي نحو معاناة الأسرى، لكنها لم تتمكّن من تحقيق تغييرات ملموسة في أوضاعهم بعد أكتوبر 2023. 3. الجهود التي بذلتها الدبلوماسية الفلسطينية الرسمية في قضية الأسرى، بما في ذلك الانضمام إلى المنظمات الدولية، يمكن القول إنها حققت إنجازات هامة في دعم هذه القضية على الصعيد الدولي، من خلال إحالة قضايا الانتهاكات إلى المحكمة الجنائية الدولية، وبناء التحالفات الدولية. نجحت الدبلوماسية الفلسطينية في تسليط الضوء على معاناة الأسرى وإدانة الانتهاكات الإسرائيلية لحقوقهم، مما أسهم في تعزيز التضامن الدولي. 4. أثبتت وزارة الخارجية الفلسطينية كفاءتها في تدويل قضية الأسرى وتسليط الضوء على الانتهاكات الإسرائيلية، من خلال تنظيم مؤتمرات دولية، وإعداد تقارير حقوقية، وتوجيه الجهود الدبلوماسية لزيادة الضغط الدولي على إسرائيل. 5. فعالية الدبلوماسية الشعبية والرقمية: أضافت الدبلوماسية الشعبية والرقمية بعدًا جديدًا في التواصل مع الرأي العام العالمي، من خلال الحملات الإعلامية على منصات التواصل الاجتماعي والفعاليات الدولية. إلا أن تأثير هذه الجهود على تحسين الظروف الإنسانية للأسرى ظل دون المطلوب. 6. تبنت الدبلوماسية الرسمية الفلسطينية نهجًا متعدد الأدوات، شمل التحركات القانونية عبر المؤسسات الدولية، والتواصل السياسي مع الحكومات والمنظمات، فضلاً عن الحملات الدبلوماسية الرامية إلى تدويل قضية الأسرى والضغط على الاحتلال لتحسين ظروفهم أو الإفراج عنهم.

Abstract

This study aimed to identify the role of Palestinian diplomacy—whether official, popular, or digital—in supporting the cause of Palestinian prisoners. It discussed the stages of development of both official and popular Palestinian diplomacy, examined the challenges it faces, and highlighted the violations suffered by the prisoners, particularly focusing on the scale of abuses that occurred after the events of October 7, 2023, in an effort to mobilize international support for their rights.In addition, the study addressed the vital role played by non-governmental organizations and civil society in supporting the prisoners, and how these entities contributed to documenting the violations committed against Palestinian detainees, as well as exposing the repeated practices of the occupation. The study is based on an integrated approach that combines the descriptive-analytical, historical, and role-based methodologies. The descriptive method is used to accurately analyze the efforts of Palestinian diplomacy, while the historical approach traces the development of these efforts. The role-based perspective focuses on the functions carried out by diplomacy, organizations, and civil society in supporting the prisoners’ cause, aiming to provide a comprehensive understanding of the role of Palestinian diplomacy on the international level.

The study reached a number of findings, including: 1. The contradiction between international law and the reality of the prisoners: International humanitarian law guarantees rights to prisoners, but Palestinian detainees in Israeli prisons are subjected to serious violations, including torture and abuse, which contradict these rights. 2. Advocacy campaigns and pressure efforts led by popular diplomacy and civil institutions have succeeded in directing international attention to the suffering of the prisoners. However, these efforts have not yet succeeded in achieving tangible changes in their conditions after October 2023 3. The efforts made by official Palestinian diplomacy in the prisoners’ issue, including joining international organizations, have achieved significant progress by referring violations to the International Criminal Court and building international alliances. Palestinian diplomacy has succeeded in highlighting the suffering of the prisoners and condemning the Israeli violations of their rights, which contributed to strengthening international solidarity.

4. The Palestinian Ministry of Foreign Affairs has proven its competence internationalizing the issue of prisoners and shedding light on Israeli violations by organizing international conferences, preparing human rights reports, and directing diplomatic efforts to increase international pressure on Israel. 5. Effectiveness of popular and digital diplomacy Popular and digital diplomacy added a new dimension in engaging with global public opinion through media campaigns on social media platforms and international events. However, the impact of these efforts on improving the humanitarian conditions of prisoners remains limited. .6The official Palestinian diplomacy adopted a multi-dimensional approach that included legal action through international institutions, political engagement with governments and organizations, in addition to diplomatic campaigns aimed at internationalizing the issue of prisoners and pressuring the occupation to improve their conditions or to demand their release.
