القواعد الفقهية الخمس الكبرى في القصص القراني استنباطاتها وتطبيقاتها

Abstract

ملخص الدراسة باللغة العربية تناولت هذه الدراسة الموسومة بـِ "القواعد الفقهية الخمس الكبرى في القصص القرآنياستنباطاتها وتطبيقاتها" القواعد الفقهية الكبرى وربطها بالقصص القرآني من خلال بيان مفهوم القواعد الفقهية والتركيز على الخمس الكبرى منها، ثم الانطلاق إلى القرآن الكريم وتطبيق هذه القواعد على بعض قصص الأنبياء وبعض الأقوام والتي تم اختيارها بناء على الموضوع الذي تناولته القصة والعبرة منها، وذلك لتسليط الضوء على جوانب من القضايا المشتركة بين القصص الواردة في القرآن الكريم وبين واقعنا المعاصر، ثم تنزيل هذه القواعد على القصص المختارة مستخدمة في ذلك المنهج الوصفي والاستنباطي والاستقرائي، من خلال التأصيل لعلم القواعد الفقهية من مصادرها،وتتبع آيات القصص القرآني المراد دراستها،واستقرائها،وتحليلها تحليلًا فقهيًّاثم استنباط القواعد الفقهية منها وتطبيقات تلك القواعد. وتبرز أهمية هذه الدراسة في أنها تبرز المعاني الواردة في الآيات الكريمة المختارة للدراسة التي تفيد في إيضاح القواعد الفقهية بما يساعد في فهمهما وتطبيقها بشكل سليم في حياتنا اليومية، كما أنها تساعد في تطبيق تلك القواعد على الأحداث والوقائع الواردة في القصص المختارة، وتقديم أسلوب جديد في تفسير القرآن الكريم على ضوء القواعد الفقهية بما يتناسب مع تقديم الحلول لمشكلاتنا في واقعنا المعاصر؛ مما يساعد في إيضاح الكثير من المفاهيم القرآنية، وإيصالها للعامة بسهولة ويسر. وقد ختمت الدراسة بجملة من النتائج والتوصيات أهمها: ورود القواعد الفقهية بوفرة في ثنايا القصص القرآني، وتميز كل قصة بالتعمق في قضية فقهية دون خلوها من فوائد فقهية في الجوانب المختلفة للحياة، وأن الأحكام المنظمة لحياة الناس تشترك في أصولها؛ لأن الطبيعة البشرية واحدة وأنها قد تختلف في بعض فروعها بحكم اختلاف العرف والظروف السائدة، ومن أبرز التوصيات: متابعة الاهتمام بدراسة علمي القواعد الفقهية والتفسير في القصص القرآني وربطهما بالواقع، وعرضهما بأسلوب ميسر يتناسب مع المبتدئين في طلبة العلم، وإجراء المزيد من الأبحاث التي تربط علم التفسير بالعلوم الشرعية الأخرى. ملخص الدراسةباللغة الإنجليزية The study, titled with “The Five Grand Jurisprudential Rules of the Qur’anic Stories: Their Deductions and Applications”, includes a look on the grand jurisprudential rules and their links with the Qur’anic stories, through clarifying the concept of the jurisprudential rules, focusing on the grand five rules, then getting to the Holy Qur’an to apply these rules on some stories related to the prophets and some peoples, these stories were selected based on their topics and their learnt lessons, in order to focus the attention on some common cases between the Qur’anic stories and our contemporary reality, then to apply these rules on the selected stories using the descriptive, deductive, and inductive approaches, through establishing the origins of the jurisprudential rules’ science using its own sources, then following the stories-related Qur’anic verses to be studied, extrapolated, and analyzed in a jurisprudential compliant way, then derive the jurisprudential rules from them and apply those rules. This study importance is based on the emphasis of the meaning of the selected Qur’anic verses, which help in clarifying the jurisprudential rules to facilitate understanding and applying them correctly in our daily life, it also helps in applying those rules on the events that are listed in the selected stories, providing a new method for interpreting the Holy Qur’an based on the jurisprudential rules, that in turn would provide an appropriate way to resolve our problems in our contemporary reality, and will help to clarify many Qur’anic concepts, and propagate them to the public audience easily. This study has been concluded by a collection of results and recommendations; the most important points include: the abundant instances of the jurisprudential rules within the context of the Qur’anic stories, each story features a deep coverage of some jurisprudential case, without overlooking any derived jurisprudential benefits related to the life’s different aspects, also the regulating provisions of the people lives have a common origins, because the human nature comes from the same source, even when its details may differ given the difference of the norms and the prevailing conditions. Also, top recommendations include continue the studies on the two disciplines of the jurisprudential rules and the Qur’anic stories interpretation, and linking them with the reality, and make them learning them affordable for the beginner-level students, and conduct more research for linking the Qur’anic interpretation (as a science) with other religion-based legal sciences.
