السياسة الشرعيّة في فكر جماعة الإخوان المسلمين دراسة فقهية تحليلية

Abstract

ملخّص الرّسالة الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه ومن اتبع هداه، وبعد: فهذه رسالة بعنوان: "السياسة الشرعيّة في فكر جماعة الإخوان المسلمين- دراسة فقهيّة تحليلية"، اشتملت على مقدّمة وثلاثة فصول وخاتمة. احتوت المقدّمة على موضوع البحث وأهدافه، أهميته وأسئلته، منهجه وخطواته، والدراسات السابقة. أمّا الفصل الأوّل فقد خصّصته للحديث عن مؤسس الجماعة الشّيخ حسن البنّا من حيث النشأة، والحياة العلميّة والعمليّة، وعن جماعة الإخوان من حيث النشأة والتأسيس والأهداف والوسائل والأساليب والنّشاط والانتشار. وفي الفصل الثاني تناولت السياسة الشرعيّة في فكر جماعة الإخوان من خلال مصادرها المعتمدة، مُنطلقاً من آراء مؤسسها الشّيخ حسن البنّا، معتمداً في تحليل قضاياها على منهاجها المعتمد "مصر نموذجاً"، ومصادره العلميّة، لأخرج من الفصل بصورة مطابقة لما في فكر الجماعة. أما الفصل الثّالث فقد تناولت فيه قضايا السياسة الشرعيّة في فكر الجماعة ومناقشتها في ضوء فقه السياسة الشرعيّة، ونظرًا لكثرة القضايا التي تستحق الدراسة والتحليل، فقد اخترت منها القضايا التالية: قواعد نظام الحكم الإسلامي، وموقف الجماعة من الشورى ومدى إلزامها، وموقف الجماعة من دوائر الوَحدة المختلفة كالوطنيّة، والقوميّة، والإسلاميّة، والإنسانيّة، وموقف الجماعة من مشاركة المرأة في العمل السياسي، وموقف الجماعة من مشاركة الأقليّة المسلمة في العمل السياسي، حيث سأتناول في كل مبحث التعريف بتلك القضية، ثم بيان موقف الجماعة منها كما جاء في مصادرها المعتمدة، ومناقشتها في ضوء فقه السياسة الشرعيّة. وفي الخاتمة عرضت النتائج التي تبيّن مدى التوافق بين الفقه السياسي لجماعة الإخوان وفقه السياسة الشرعيّة من جهة، ومدى انسجام الجماعة مع أهدافها ومرتكزاتها من خلال برامج أجنحتها السياسيّة، خاتمًا بأهمّ التوصيات التي خرجت بها من البحث. Summary Praise be to Allah, our Lord of the Universe: prayers and peace be upon Muhammad, the faithful Prophet, sent as a mercy to the worlds. All Muslims greet those who follow him with righteousness till the Day of Judgment. This research is titled: "The Islamic Legal Policy in the thought of Muslim Brotherhood: An Analytical Jurisprudential Study". This research includes an introduction, three chapters and a conclusion. In the he first chapter: the researcher has talked about the founder of the group: “Sheikh Hassan Al-Banna,” in terms of his upbringing, scientific and practical life. The researcher has talked about "The Muslim Brotherhood", in terms of its origins, founding, goals, means, methods, activity and spread out. In the second chapter: the researcher has discussed the Sharia Policy in the group’s thought through its approved sources, based on the opinions of the group’s founder, Sheikh Hassan Al-Banna, relying in analyzing its issues on the Islamic Sharia platform. The researcher has already taken “Egypt” as a model for the issues of the Islamic nation. The researcher has relied on scientific sources in the analysis process, so that he would emerge from the second chapter in a manner consistent with what has already stated in the thought held by the group. In the third chapter: the researcher has dealt with the issues of Islamic Sharia Policy in the group’s thought. He has discussed these issues in the light of Sharia Policy. In addition, he has given the large number of issues that deserve study and analysis. Thus, he has chosen the following issues from them: The rules of the Ruling System in Islamic Governance. The Group’s Position on the Shura System in Islam, the extent of its obligation. The Group’s Position on the various circles of unity such as patriotism, nationalism, humanity, Islam; the group’s position on women’s participation in politics. The Group’s Position on the participation of Islamists in political action, as they are a minority in Parliament. In each section, the researcher will address these issues. Then the researcher will explain the group’s position on these issues as stated in its approved sources and discuss it considering the Jurisprudence of Sharia Politics and priorities. In the conclusion, the researcher will present the results that show the extent of agreement or difference between the Islamic Political Jurisprudence of the Muslim Brotherhood, on the one hand, the extent of the group’s harmony with its goals and foundations, through the programs of its political wings. The researcher will conclude his research with the most important recommendations that emerged from this scientific thesis.
