الإصلاح الأسري في المحاكم الشرعية الفلسطينية دراسة فقهية قانونية

Abstract

ملخص الرسالة لقد تناولت في رسالتي هذه الإصلاح الأسري في المحاكم الشرعية الفلسطينية دراسة فقهية قانونية، وهدفت هذه الدراسة التعرف على مفهوم الإصلاح الأسري وتطبيقاته في المحاكم الشرعية الفلسطينية، وبيان أهم المعيقات التي تواجه الأسرة، وذلك بتوضيح الأسباب التي تؤدي إلى حدوث التفكك الأسري، ونشوب النزاعات الأسرية، واتبعت هذه الدراسة المنهج الاستقرائي، والمنهج الفقهي المقارن والمنهج الاستنباطي والتحليلي، مستعينة بما جاءت به أحكام الشريعة الإسلامية، وآراء الفقهاء والمختصين. فجعلت رسالتي من ثلاثة فصول: فتكلمت في الفصل الأول عن حقيقة الإصلاح الأسري، ونشأته وأهميته ومشروعيته، من خلال توضيح مفهوم الأسرة والإصلاح الأسري. وفي الفصل الثاني فتكلمت في مقومات الإصلاح الأسري من خلال توضيح عوامل استقرار الأسرة والحقوق والواجبات الأسرية. وفي الفصل الثالث فتكلمت في الجانب الإجرائي للإصلاح الأسري من خلال البحث في الإجراءات ومفاهيم وسائل الإصلاح الأسري وتطبيقاتها أما الجهات المختصة. ثم ختمت هذه الرسالة بخاتمة تضمنت أهم النتائج والتوصيات ومن أبرز هذه النتائج: أن الأسرة هي النواة الأولى في تكوين المجتمعات، لذلك يجب الاهتمام بها، وإيجاد مجتمع قوي، ينعم بأسر صالحة قوية، خالية من المشاكل والاضطرابات النفسية والتفكك، فالإسلام أولى اهتماماً كبيراً بالإصلاح بشكل عام، والأسري بشكل خاص، وجعل للساعين في الإصلاح الأجر العظيم والثواب الجزيل الذي قد يفوق أجر الصلاة والصيام، وأظهرت النتائج أن قيام الزوج والزوجة بالمهام الموكلة لكل منهما كفيل أن يجعل الأسرة سعيدة ومتماسكة، فتقوم الزوجة بتربية الأولاد، ويقوم الزوج بالنفقة على الأسرة، ويتعاونان على إيجاد جيل مسلم، تربى على العقيدة الإسلامية والأخلاق الصحيحة. وكذلك من أبرز التوصيات: أوصي بتشكيل شخصية الأبناء، وتربيتهم بعيدا عن المفسدات الحديثة التي حصلت بسبب الثورة التكنولوجية، تحت مراقبة الآباء المشددة، واختيار ما ينفعهم ويفيدهم، وتوجيه المشرع الفلسطيني لإيجاد قوانين تنطلق من المنظور الإسلامي لحماية الأسرة من التفكك، مثل هيئات إصلاح أسرية حقيقية لا شكلية، كما هو حاصل اليوم، تشرف عليها المحاكم الشرعية للإصلاح الأسري، إضافة إلى وجوب انسحاب الحكومات العربية - خصوصا الفلسطينية - من الاتفاقيات الدولية الهدامة التي تهدف إلى إلغاء دور الأسرة في التربية والرعاية الصحيحة للأبناء. وكذلك قمت بوضع قائمة لمسارد الرسالة وقائمة المحتويات وقائمة للمصادر والمراجع.

Abstract In this study, dealt with family reform in the Palestinian Sharia courts as a legal jurisprudential study. This study aimed to identify the concept of family reform and its applications in the Palestinian Sharia courts, and to explain the most important obstacles facing the family, by clarifying the reasons that lead to family disintegration and the outbreak of family conflicts. This study followed the inductive approach, the comparative jurisprudential approach, and the deductive and analytical approach, drawing on the provisions of Islamic Sharia and the opinions of jurists and specialists. So I made my thesis into three chapters: In the first chapter, I spoke about the reality of family reform, its origin, importance and legitimacy, by clarifying the concept of family and family reform. In the second chapter, I talked about the components of family reform by clarifying the factors of family stability and family rights and duties. In the third chapter, I spoke about the procedural aspect of family reform through research into the procedures and concepts of family reform methods and their applications to the competent authorities. Then I concluded this thesis with a conclusion that included the most important results and recommendations. The most prominent of these results are: The family is the first nucleus in the formation of societies, so it must be taken care of, and a strong society should be created, blessed with good, strong families, free of problems, psychological disorders, and disintegration. Islam gives great attention to reform in general, and family reform in particular, and gives those who seek reform a great reward and a great reward. Which may exceed the reward of prayer and fasting, and the results showed that the husband and wife carrying out the tasks assigned to each of them is enough to make the family happy and cohesive, so the wife raises the children, the husband provides for the family, and they cooperate to create a Muslim generation, raised in the Islamic faith and correct morals. Among the most prominent recommendations are: I recommend shaping the character of children, raising them away from the modern corruptions that have occurred due to the technological revolution, under the strict supervision of parents, choosing what will benefit and benefit them, and directing the Palestinian legislator to find laws based on the Islamic perspective to protect the family from disintegration, such as real, not formal, family reform bodies, as is the case. Today, it is supervised by Sharia courts for family reform, in addition to the necessity of Arab governments - especially Palestinian ones - withdrawing from destructive international agreements that aim to abolish the role of the family in the proper education and care of children.
