التكييف الفقهي للنوازل المعاصرة دراسة تأصيلية تطبيقية

Abstract

الملخص هذه الرسالة بعنوان (التكييف الفقهي للنوازل المعاصرة. دراسة تأصيلية تطبيقية)، اشتملت على أربعة فصول، تم في الفصل الأول التأصيل للاجتهاد في النوازل، وبيان موقع التكييف الفقهي فيه. أما في الفصل الثاني فقد تم التعريف المفصل بالتكييف الفقهي، وبيان علاقته بتحقيق المناط، وتناول الفصل الثالث آلية التكييف الفقهي، مع بيان أهم العوامل المؤثرة فيه، و يأتي الفصل الرابع تطبيقاً لما سلف، حيث بحثت فيه ثلاث نوازل معاصرة،مع تسليط الضوء على تكييفها الفقهي، وصولاً لحكمها الشرعي الصحيح،لتتجلى أهمية التكييف الفقهي في استنباط الأحكام الشرعية الصحيحة للنوازل، وأثره في اختلاف الفقهاء. وتهدف الرسالة إلى تأصيل التكييف الفقهي ويان مختلف المباحث المتعلقة به، وإعطاء نماذج تطبيقية عليه، أما مشكلة الرسالة فتتمثل في تأصيل التكييف الفقهي وبيان آليته ومجالات تطبيقاته. ومن أهم النتائج المتوصل إليها أن الاجتهاد الفقهي المعاصر له شقان: نظري، وتطبيقي، وأن التكييف الفقهي هو مرحلة من مراحل الشق التطبيقي، وأنه يعني إلحاق النازلة بأصل فقهي يشبهها، وأنه مرادف لتحقيق المناط عند الإمام الشاطبي( )، ويؤثر فيه العديد من العوامل، أهمها: الواقع، ومقاصد الشريعة، ومآلات الأفعال، ولأهل الخبرة والاختصاص دور كبير في التكييف الفقهي للنوازل مما يدل على أهمية الاجتهاد الجماعي، وللاختلاف في التكييف الفقهي للنوازل أثر بالغ في اختلاف الفقهاء في الأحكام الشرعية المستنبطة لهذه النوازل. وتوصي الباحثة فقهاء العصر وباحثيه بدراسة النوازل المعاصرة وفقه واقعها بشكل دقيق لأجل تصورها تصوراً سديداً، ومن ثم تكييفها فقهياً بشكل صحيح، واستنباط الأحكام الشرعية السليمة لها، وإيلاء التكييف الفقهي مزيد اهتمام خلال الاجتهاد في أحكام النوازل؛ لأنه الخطوة السابقة للحكم الشرعي، وعليه تتوقف صحته. كلمات مفتاحية:تحقيق المناط، أهل الخبرة والاختصاص، البتكوين، المايكروبليدنج، تحديد جنس الجنين.

Jurisprudential Description of Contemporary Issues By Nidaa' Aziz Dweik Abstract As its title indicates, this scientific study addressed Jurisprudential Description of contemporary issues. It contains four chapters: The first chapter was devoted to the bases of assiduousness in contemporary issues and the location of Jurisprudential Description within its context. The second chapter dealt with the details of Jurisprudential Description- and sheding light on its relationship with achieving the objectives or applying general rule to individual case. In the third chapter, the author dealt with the tools of Jurisprudential Description and the general factors affecting it. In the fourth chapter, general applications of the above_mentioned tools have been discussed. There contemporary issues were explained thoroughly in their Jurisprudential Description context. The final objective of the author is to derive the correct Islamic ruling for each one of these contemporary issues. The reader of this research should take these issues as models for other contemporary issues. Building on the above_mentioned derivatives make crystal clear the significance of Jurisprudential Description in deriving the correct Islamic ruling for abrupt contemporary issues and showing their effect on different scholars' opinions. Among the final results, the researcher highlights that Jurisprudential Description has two branches, one is theoretical and the other is applicable. Jurisprudential Description is a step in the theoretical side. This means connecting any contemporary issue with a similar Jurisprudential Description origins. Such a process is "achieving objectives" in Imam Shatipi's fiqh or investigation rule's compatibility. Many factors are affecting this process, such as: Main objectives of Islamic law, the true nature of the contemporary issue and the consequences of actions. In addition to that the role of scholars or those experienced and specialists in Jurisprudential Description of contemporary issues. All of the above highlights the significance of collective effort of scholars " ijtihad" who are qualified in exerting their best end to arrive at the proper Islamic ruling regarding the disputed issue at hand. At this point appears the dire need for the differences of scholars and their ijtihad in the derived Islamic rulings. The researcher advocates the contemporary scholars to search in depth the contemporary issues in their practical settings in order to arrive at comprehensive understanding at its best. Then, and then only, they will be able to conclude their best Jurisprudential Description. The later should be given more attention in deriving Jurisprudence’s rules. This process is mandatory as a precedence for final Islamic ruling for contemporary issues appear in Muslims affairs, on which depends its validity and correctness.
