العدالة و تطبيقاتها في المحاكم الشّرعية

Abstract

ملخص البحث جاء هذا البحث بعنوان "العدالة وتطبيقاتها في المحاكم الشرعية"، وقد جاء اختيار هذا الموضوع من أجل التأكيد على أهمية تطبيق العدالة في المحاكم عامة، ولن يتمّ ذلك إلا من خلال إيجاد تنظيم وإعطاء كل صاحب حقٍّ حقّه، ومن هنا تَكوّن البحث من مقدمة وخمسة فصول وخاتمة، أما الفصل التمهيدي، فقد تضمن التعريف بالقضاء ومشروعيته وحُكمه، كما تضمّن تعريف العدالة وبيان مشروعيتها وبيان أهدافها وأهميتها وضوابطها، وبعد ذلك قمت ببيان وسائل تطبيق العدالة. وأمّا الفصل الأول، فقد كان الحديث فيه عن دور الحاكم في تحقيق العدالة، فتحدثت فيه عن تعريف الحاكم والشروط الواجب توفرها فيه وتعيينه في الإسلام، كما تحدّثت فيه عن تنصيب الحاكم، وفي ختام هذا الفصل عن ضمانات تحقيق العدالة من الحاكم. وأما في الفصل الثاني، فقد تحدثت فيه عن دور القاضي وأعوانه في تحقيق العدالة، فتحدثت فيه عن شروط القاضي، ثم كان الحديث بعد ذلك عن أثر اختلاف عدالة القاضي على انتهاء ولايته، وفي ختام هذا الفصل قمت ببيان شرط العدالة في أعوان القاضي. وأما في الفصل الثالث، فقد جاء الحديث فيه عن الحُكم بالعدل، وقد تحدّثت فيه عن الحكم القضائي، واشتمل الحديث فيه على القضاء بالراجح من الأدلة، ونقض القاضي أحكامه بنفسه وأحكام غيره، وحُكم القاضي لنفسه أو لأقاربه، وجاء بعد ذلك الحديث عن دور الشّهادة في تحقيق العدالة، ثم جاء الحديث بعد ذلك عن حُكم اشتراط العدالة في الشّهود، وبعد ذلك عن صفة العدالة المُشترطة، ثم جاء الحديث عن آلية تزكية الشّهود، وفي ختام هذا الفصل جاء الحديث عن حالات رد شهادة العدل. وختمت هذا البحث بالفصل الرابع، والذي كان الحديث فيه عن تحقيق العدالة في انعقاد عقد النكاح، فكان الحديث فيه عن العدالة من خصال الكفاءة بين الزوجين، وعن العدالة في ولي عقد النّكاح، وعن العدالة في شهود عقد النّكاح، ثم جاء الحديث بعد ذلك عن أثر اختلال العدالة على حقوق الزوجة. وفي ختام هذه الأطروحة توصلت إلى مجموعة من النتائج والتوصيات، والتي أوصي من خلالها إلى ضرورة وجود رقابة على من يقوم بعمله في محاكمنا الشرعية لإيجاد عملٍ نزيه.

Abstract This research was entitled “Justice and it’s Applications in Sharia Courts”, the selection of this subject was to emphasize the importance of justice in public courts, and this will only be done by creating a regulation and giving everyone his due. Due to this, this research composed of an introduction, five chapters and a conclusion. The introductory chapter composed of a definition of the judiciary, it’s legitimacy and rule, it also included a definition of justice and a clarification of it’s legitimacy, goals, importance and control. Thereafter, I clarified the means to achieve justice. The first chapter talked about the role of the ruler to achieve justice. I talked about the ruler’s definition, the conditions that must be met in him and his appointment in Islam. At the end of this chapter I talked about the guarantees of the ruler in order to achieve justice. As for the second chapter, I talked about the role of the judge and his aides in achieving justice and the conditions that must be met in the judge. Then, I talked about the effect of the judge’s justice differing on the end of his term. At the end of this chapter I explained the conditions of justice that must be met in the judge’s aides. As for the third chapter, it included fairness in passing judgments and adjudication. It also included to judge based on evidence, the judge’s overturn to his own verdict and the verdict of others and the judge’s verdict for himself and his relatives. It also included the role of testimony in achieving justice, the justice condition that must be met in the witnesses and the condition of justice required in the witnesses. Thereafter, I talked about the commendation of the witnesses. At the end of the chapter I talked about the cases of rejecting a testimony. I closed this research with a fourth chapter which talked about achieving justice in holding a marriage contract, it also talked about the justice as an efficiency quality between the spouses, the justice of the guardian of the marriage contract and the witnesses to the marriage contract, then I talked about the effect of injustice to the wife rights. At the end of this dissertation I reached to a number of finding and recommendations which, through it, I recommend to have control and observation over who does his work in our Sharia courts to have an honest work.
