هدف هذا البحث إلى التعرف على تأثير دور المهندس على إدارة عقد المقاولة الموحد (الفيديك) في فلسطين من وجهة نظر المقاولين، من خلال معرفة العلاقة بين دور المهندس وإدارة عقد المقاولة الموحد وتحديد اتجاهات المقاولين نحو تأثير دور المهندس على إدارة عقد المقاولة الموحد (الفيديك) في فلسطين والتي تعزى للمتغيرات التالية: الجنس، الفئة العمرية، المؤهل العلمي، المسمى الوظيفي. استخدمت الباحثة في هذا البحث المنهج الوصفي التحليلي الذي يعتمد على دراسة ووصف الظاهرة في الوقت الحاضر وكما هي في الواقع وتحليلها، من خلال فحص الفرضيات المتعلقة بالظاهرة المدروسة، ويتكون مجتمع الدراسة من جميع المقاولين المصنفين المسجلين لدى اتحاد المقاولين الفلسطينيين في الضفة الغربية والبالغ عددهم (314)، وتتكون عينة الدراسة من (173) من المقاولين المصنفين لدى إتحاد المقاولين الفلسطينيين في الضفة الغربية، تم اختيارهم بالطريقة العشوائية المنتظمة حيث تم توزيع (173) استبانة، وقد تم استرداد (126) استبانة وبذلك تكون نسبة الاسترداد 73% من الإستبانات الموزعة و40% من مجتمع البحث، تكونت من أربعة أقسام، وتم التحقق من صدق الأداة بعرضها على عدد من المحكمين، كما تم حساب الثبات لأداة البحث بأقسامها المختلفة بطريقة الاتساق الداخلي بحساب معامل كرونباخ ألفا، وتبين تمتع الإدارة بدرجة جيدة من الثبات، بالإضافة إلى إستخدام أداتين إضافيتين هما المقابلات حيث قمت بعمل سبع مقابلات إستهدفت محكمين في مجال عقود الفيديك ومقاولين ومكاتب إستشارية ومالكين لمشاريع كبيرة، وذلك لجمع البيانات النوعية حيث تكونت المقابلة من أربعة أقسام من الأسئلة تم طرحها على الفئات المستهدفة كل حسب موقعه، مع إثراء البحث بأداة أخرى هي الملاحظة الشخصية خلال فترة تنفيذ عدة مشاريع خلال فترة البحث. وقد أظهر البحث العديد من النتائج أبرزها، وجود أثر كبير لدور المهندس على إدارة عقد المقاولة الموحد (الفيديك)، وذلك من خلال تأهيله ومن ثم التزامه بالحيادية، بالإضافة إلى وجود الضوابط عليه على إدارة عقد المقاولة الموحد ( الفيديك).

Abstract The Impact of the Role of the Engineer in Managing the Unified Conditions of Construction Contracts “FIDIC” in Palestine – From Contractors Point of View This research is aimed at recognizing the impact of the engineer’s role in managing the unified conditions of construction contracts (FIDIC) in Palestine from point of view of contractors by understanding the relation between the role of the engineer and the management of the unified construction contracts, and determining the views of the contractors towards the impact of the engineer on managing the unified construction contracts in Palestine which is attributed to the following variables: gender, age, qualification & job title.

The researcher used the analytical descriptive method which depends on the description of the phenomenon at present, and in reality analyse the phenomenon through examining the hypothesis under study.

The study population consists of all classified & registered contractors at the Palestinian contractors union in the West Bank, with a total number of (314). The study specimen consists of (173) classified contractors by PCU in the West Bank, these were randomly chosen. (173) questionnaires were distributed from which (126) responses were collected, amounting to (73%) of the distributed questionnaires, and (40%) of the research community, that consisted of (4) sections, credibility of the tool was verified by presenting it to a number of referee’s, the stability of the research tool in its various sections was calculated by the internal consistency method by estimating the Alpha Cronbach coefficient. It was shown that the management enjoys a good degree of stability, in addition to the use of two additional tools; interviews where seven interviews were conducted targeting FIDIC contract experts, contractors, consulting engineering offices and owners of large projects, in order to collect quality data. The interview consisted of (4) sections of questions that were presented to the targeted group each according to their location.

The research was enriched by the use of another tool being the personal observation of several projects under implementation during the research period.

The research has shown several results, most notably; the demonstrated that there is an impact of the role of the engineer on the management of the unified construction contracts, (FIDIC), through the rehabilitation and then commitment to neutrality, in addition to controls demonstrated on the managemet of FIDIC contracts.
