Abstract: الملخص الحمد لله الذي بنعمته تتم الصالحات, والصلاة والسلام على سيدنا محمد  وعلى آله وصحبه أجمعين وبعد: فقد عرضت في بحثي هذا وأصلت لأصول المحاكمات الشرعية, حيث تكون البحث من مقدمة وثلاثة فصول وخاتمه وملحق, وكان الفصل الأول عبارة عن فصل تمهيدي, حيث تضمن التعريف بالقضاء ومشروعيته وحكمته, ثم دراسة تاريخية للقضاء وأصول المحاكمات انطلاقاً من العصر الجاهلي وصولاً إلى عصرنا الحاضر. ثم تطرقت في الفصل الثاني للحديث عن تأصيل أصول المحاكمات الشرعية الموضوعية, من حيث التعريف بأصول المحاكمات الشرعية, وتأصيل المبادئ الموضوعية التي يرتكز عليها التنظيم القضائي, ثم أصلت للأحكام المتعلقة بالقاضي وأعوانه, وكذلك الدعوى, ثم بينت فيه أهم وسائل الإثبات في الشريعة الإسلامية, وختمته بتأصيل قواعد الاختصاص في المحاكم الشرعية. وأما في الفصل الثالث فقد قمت بالتأصيل فيه لأصول المحاكمات الشرعية الإجرائية, من حيث التأصيل للشروع في الدعوى, والتأصيل لإجراءات المحاكمة, وكذلك أصلت فيه للحكم الشرعي, وختمته بتأصيل الطعن في الأحكام القضائية. وكذلك ضمنت البحث ملحقاً بقانون أصول المحاكمات الشرعية الأردني رقم (31) لسنة (1959), مع الإشارة إلى أهم المواد التي قمت بالتأصيل لها. Fundamentals of Islamic Court Trials Review and Investigation by Mohammed Izzat Hamid An-Nawaj'ah Supervised by Prof. Ayman Abdulhameed Al-Badareen Abstract Praise be to Allah, for good works are never accomplished without His grace, and may His peace and blessings be upon His Prophet Muhammad, his family and companions. The present study reviews and investigates the fundamentals of Shari'a (Islamic) court trials. It consists of an introduction, three chapters, a conclusion and an appendix. The first chapter is an introductory chapter. It includes a definition of the judiciary, its legitimacy and benefits. This chapter also reviews the history of judiciary and principles of trials from the pre-Islamic era up to the present time. The second chapter is concerned with the fundamentals of the objective Shari'a court trials. It includes a definition of these court trials and an investigation into the principles underlying the judicial system, the provisions relating to the judge and his assistants, and the lawsuit. This chapter also shows the most important means of evidence in Islamic law, and it concludes with a review of the jurisdiction rules of the Shari'a courts. The third chapter deals with the fundamentals of procedural Shari'a court trials. It investigates the procedures of filing a lawsuit in Shari'a courts, trial proceedings, Shari'a court rulings, and challenging court decrees. The research also includes an appendix of Jordan's Islamic law of Shari'a Trials No. 31 of 1959, with a reference to the most important articles investigated in this study.
