الوكالة في مسائل الأحوال الشخصية دراسة مقارنة

Abstract

ملخص الرسالة جاءت هذه الرسالة بعنوان" الوكالة في مسائل الأحوال الشخصية دراسة مقارنة"، وتكونت من مقدمة وأربعة فصول وخاتمة: أما المقدمة: فتحدث الباحث فيها عن أهمية الموضوع والمنهجية التي التزم بها. فكان الفصل الأول: بعنوان: "ماهية الوكالة ومفهوم الأحوال الشخصية وموضوعاتها"، وقد تناول فيه الباحث تعريف الوكالة لغة واصطلاحاً ومشروعيتها، والألفاظ ذات الصلة بالوكالة، وأركانها وطرق انتهائها، ثم تطرق الباحث إلى تعريف مصطلح الأحوال الشخصية ونشأة هذا المصطلح وموضوعاته. أما الفصل الثاني: فكان بعنوان: " الوكالة في عقد الزواج" وقد تناول فيه الباحث تعريف الزواج، ثم بيان حكم توكيل الزوج والولي والمرأة غيرهم في عقد النكاح، ثم تناول الباحث مسائل متفرقة في التوكيل في عقد النكاح وهي: تولي الوكيل طرفي العقد، وتوكيل الوكيل غيره، وتوكيل الصبي، وتوكيل المُحْرِم. أما الفصل الثالث: فكان بعنوان: " الوكالة في فُرَق عقد الزواج" وقد تناول فيه الباحث تعريف فُرق الزواج وموضوعاته، ثم بيان تعريف الطلَّاق ومشروعيته، وبيان آراء الفقهاء في مشروعية التوكيل في الطلاق، ثم تطرق الباحث إلى تعريف وبيان حكم كل من التوكيل في الخلع واللعان والإيلاء والظهار والرجعة. أما الفصل الرابع: فكان بعنوان: " الوكالة في الوصية والوقف" تناول فيه الباحث تعريف الوصية ومشروعيتها، وتوكيل الوصي غيره، ثم تعريف الوقف ومشروعيته، والتكييف الفقهي للناظر على الوقف، والتوكيل في النظر على الوقف. وتضمنت الرسالة موقف قانون الأحوال الشخصية الأردني لعام 1976م المعمول به في الضفة الغربية من هذه المسائل إن وُجد للقانون نص في المسألة. ثم وضع الباحث خاتمة سجَّل فيها ما خَلُصَ إليه من نتائج وتوصيات، وفي النهاية أضاف ملاحق للرسالة وهي عبارة عن نماذج تطبيقية للوكالة في مسائل الأحوال الشخصية المطبقة في المحاكم الشرعية في الضفة الغربية.



The summary of the thesis The title of this thesis is, (the deputyship (proxy) in personal status issues a comparative study.) the thesis consists of an introduction, four chapters and a conclusion. 1) The introduction : The researcher highlighted the importance of this subject "deputyship" and the methodology that he followed and committed himself to. 2) Chapter One : The title of this chapter is : (Deputyship and the concept of the personal status and other related subjects ) . The researcher elaborated on the definition of (deputyship (proxy), explaining both the denotation of the word and the deep meaning properly according to the Islamic rules, in addition to all related words to the concept of (deputyship), its basis and origin. 3) Chapter Two : The title of this chapter is: (deputyship to the contraction of marriage ) . The researcher explained the definition of marriage and the provision of authorizing other foreign people in the bride's, groom's contraction of marriage. He explained other issues including authorizing different kinds of people in the contraction of marriage such as adults, kids and foreigners.

4) Chapter Three : The title of this chapter is: ( Deputyship in divorcing ) . The researcher explained the definition of divorcing and other doctrine issues, such as the viewpoints of legal experts (legists). He explained the definition of divorcing and its legitimacy and viewpoints of legal experts of divorcing. He pointed out whether it is possible to authorize other people in divorcing and authorizing one's wife or not . 5) Chapter Four : The title of this chapter is: (Deputyship of the will "legacy"). The researcher explained the definition of the will and its legitimacy. He explained whether we can authorize the executor other foreign people. He talked about the Islamic religious endowments and its legitimacy. Finally, the thesis includes the position of the Jordanian personal status law for the year 1976 which is being applied in the West Bank nowadays. 6) The conclusion : The researcher came up with many useful recommendations and results. He also attached an appendix that includes samples of real deputyship applied in courts.
