Abstract

الدولة المدنية في ضوء السياسة الشرعية إعداد الطالب: عمار عبد المنعم الدويك إشراف الدكتور: مهند استيتي –حفظه الله- تناولت هذه الرسالة موضوع ( الدولة المدنية في ضوء السياسة الشرعية ) في ثلاثة فصول إضافة إلى المقدمة والخاتمة التي احتوت على أبرز النتائج والتوصيات. وتحدث الفصل الأول عن تأصيل السياسة الشرعية من حيث معناها العام والخاص, وأسسها ومجالاتها, وحجية العمل بها وضوابط ذلك. وتناول الفصل الثاني -في المبحثين الأول والثاني- مفهوم الدولة المدنية ونشأتها والأصول القائمة عليها. وجرى الحديث في المبحث الثالث عن الدولة الدينية مبينا نشأتها وحقيقتها ووزنها في السياسة الشرعية. وقد تناول الفصل الثالث الحديث عن مدى مشروعية الدولة المدنية بمرجعية إسلامية, والكلام عن حكم استخدام المصطلحات الوافدة في ضوء السياسة الشرعية, وتم عرض آراء المعاصرين في حكم إطلاق مصطلح الدولة المدنية بمرجعية إسلامية مع بيان الخلاف بينهم بين مانع ومجيز, ثم الترجيح بين الآراء. وفي الخاتمة تم عرض النتائج والتوصيات التي توصلت إليها.

This research includes three chapters inaddition to introduction and conclusion. As follows: the first chapter is about the essence, basis, rules and feilds of the legal politics, that divided for four titiles: the first title is about the defenition of legal politics, the second one is about the causes of working in it.the third one is talking about the ruels of working in legal politics and their domains.the last one is about the basis of legal politics The second chapter comprise two sections, the first section I talk about the civil and religious state, there assets and difrences between them in view of legal politics, and the second section include the essence of religious state and there origions in legal politics I spoke in the third chapter about the legality of civil state in islamic refrence in the view of legal politics.it contains two subjects, the first one is about the terminology expression in the view of legal politics. which has two requeriment: the first on is about the judgment of use the forign expression in the view of legal politics, the second one is explain the essence of civil state in islamic reference.The second subject illustrate the judgment of principleof the rules of islamic state implementation in the view of legal politics, which talks about three requierments, permissive, inhibtors in their evidences and penalties. I ask Allah to make this work purely and that would benefit me and Muslims.
