قضايا التركات المعاصرة وتطبيقاتها في المحاكم

Abstract

ملخص تناولت هذه الرسالة موضوعاً مهماً من مواضيع الفقه الإسلامي, وهو موضوع" قضايا التركات المعاصرة وتطبيقاتها في المحاكم" , وتكونت من مقدمة وفصل تمهيدي, وأربعة فصول رئيسة, وخاتمة, وفيما يأتي تفصيل ذلك: احتوت المقدمة على افتتاحية للبحث وموضوعه, وأسباب اختياره, وأهميته, ومشكلته, والدراسات السابقة, وحدود الدراسة والمنهج المتبع. واحتوى الفصل التمهيدي على الحيل في قضايا التركات, واحتوى الفصل الأول على الأحكام المتعلقة بالتركة حال حياة المورث, كالمسائل المتعلقة بقسمة المورث لأملاكه على ورثته أثناء حياته. واحتوى الفصل الثاني على الأحكام والقضايا المترتبة على التباطؤ في قسمة التركات, كأحكام النماء والخسارة, والغصب وما إلى ذلك من الأحكام. واحتوى الفصل الثالث على أهم القضايا والأحكام المتعلقة بميراث المرأة, كقضية التخارج العام من التركة, ورجوع المرأة عن تنازلها, وكيفية صيانة حق المرأة في الميراث. واحتوى الفصل الرابع على قضية الراتب التقاعدي من منظور الفقه الإسلامي, من حيث حكمه وحقيقته, وتكييفه الفقهي, وبيان المستحقين له في الشريعة والقانون. وكان من أهم النتائج: أن الوارث الذي يضع يده على التركة, ويمنع تقسيمها لغير مسوغ شرعي يعد غاصباً, وتجري عليه أحكام الغصب في حال نقصان التركة, وأن الراتب التقاعدي لا يأخذ حكم الميراث. وأوصت الرسالة بضرورة البحث في قضايا التركات المعاصرة التي لم تتناولها الرسالة, كالمسائل المتعلقة بالوصايا والتجهيز, ومسائل التعويضات ومكافئة نهاية الخدمة.

Abstract This thesis took an important subject from Islamic jurisprudence which is current inheritance issues and the application of it in courts. It consists of general introduction about subject in addition to five major chapters: introduction chapter and four main chapters and it was ended by conclusion. The general introduction contained the general view about the subject, the causes for choosing of this subject, the importance of it, the problem statement, literature review, the boundaries of the study and methodology. The first chapter (introduction ) talked about the different tricks in inheritance issues. It also talked about the issues that related to the inheritance division of person who will inherit her /his possessions to the inheritors during his/her life. The second chapter included the issues that related to the effects of the slowing in the inheritance division process between the inheritors. These issues include: financial development, losing and usurpation issues and other provisions that related to that. The third chapter included the most important issues that related to woman inheritance like: 1. Avoidance of her from inheritance and giving her a little reward to give her waiver 2. The change and refuse of woman of her waiver after her acceptance 3. How the right of woman in inheritance can be protected. The fourth chapter mentioned the retirement salary subject from the Islamic jurisprudence view: 1. Its provision 2. Its realty 3. Its jurisprudential adjustment 5. Who deserve it in law and Islam. The most important results of this research are: 1. The inheritor who takes the inheritance and prevents its division between the inheritors who deserve it without any Islamic rationales is considered as usurper and the usurpation provisions will be applied on them in the situation of intentional decreasing of inheritance by them . 2. The retirement salary doesn’t take the inheritance provision. The thesis recommended the importance of researching in current inheritance issues that this thesis didn’t mention them such as: commandments, how to prepare the dead person after dying, how to compensate the workers from any injuries, in addition to the rewards after the end of work.
