Abstract: نظامالقضاءالشرعيفي الدّاخل الفلسطينيّ وتطبيقاته يناول هذا البحث الحديث عن نظام القضاء الشرعي في الدّاخل الفلسطينيّ وتطبيقاته، وذلك بالنظر لما للقضاء الشرعي من أهمية في المحافظة على كيّنونة الأسرة المسلمة اليوم. وقد انتظمت هذه الدراسة في مقدمة وأربعة فصول، وذيلت البحث بخاتمة تتضمن النتائج والتوصيات لهذه الدراسة، وتم في هذا البحث مناقشة مسائل تتعلق بالقضاء الشرعي في الداخل الفلسطيني مثل الحديث المحاكم الشرعية وشرعيتها التاريخية، وحكم تولي القضاء فيها رغم تبعيتها لوزارة العدل الإسرائيلية. وأبرز البحث بعض القضايا مثل عرض القوانين الإسرائيلية وكيف قلصت بعض صلاحيات المحاكم الشرعية، وأصبحت المحاكم النظامية لها صلاحيات موازية للمحكمة الشرعية، وأثر ذلك في التوجه إلى المحاكم النظامية التي لها صلاحية موازية للمحاكم الشرعية، وبيان الحكم الشرعي في ذلك. وجرى الحديث أيضا عن أهم القوانين الشرعية التي تنظم عمل القضاء في المحاكم الشرعية، ومحاولة تعديلها وتوزيع الصلاحيات على المحاكم النظامية. وكان من بين القضايا التي ناقشها شروط تولي القضاء في المحاكم الشرعية حسب القانون الإسرائيلي، وقضية تعيين المرأة في منصب قاضية في المحاكم الشرعية، لأول مره في الداخل الفلسطيني. كما تطرق البحث إلى بيان درجات المحاكم الشرعية وصلاحيتها، وتنازع الاختصاص بين المحاكم الشرعية والمحاكم النظامية، وعمل محكمة الاستئناف الشرعية. وأخيرا خلص البحث إلى بيان أهم النتائج التي توصل لها البحث من خلال التحليل، وكذلك ذكر أهم التوصيات التي أوصى بها الباحث.   Abstract The Sharia Judiciary System in the Palestinian Interior and Its Applications This research deals with the discussion of the Sharia judiciary system in the Palestinian interior and its applications, given the importance of the Sharia judiciary in preserving the identity of the Muslim family nowadays. This study contains an introduction, four chapters, and a conclusion that includes the results and recommendations. This research also discussed issues related to the Sharia judiciary in the Palestinian interior, such as the Sharia courts and their historical legitimacy, and the Islamic attitude on taking over the judiciary in them despite their subordination to the Israeli Ministry of Justice. The study focused on some issues such as showing the Israeli laws and how some of them reduced the powers of the Sharia courts. More examples of these issues are that the regular courts have become parallel to the Sharia court, the impact of this on going to the regular courts that have jurisdiction parallel to the Sharia courts, and showing the Islamic attitude on that. The study also talked about the most important Sharia laws that regulate the work of the judiciary in the Sharia courts, and the attempt to adjust them and distribute powers to the regular courts. Moreover, the study discussed the conditions for assuming the judiciary in Sharia courts according to the Israeli law, and the appointing a woman to the position of a judge in Sharia courts, for the first time in the Palestinian interior. The research also brought to light the degrees and powers of the Sharia courts, the conflict of jurisdiction between the Sharia courts and the regular courts, and the work of the Sharia Court of Appeal. Finally, the study was concluded by showing the most important results and the most important recommendations. Keywords: The Palestinian interior, the Sharia judiciary, the Sharia court, Sharia laws.
